Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Arisecraft Technologies ("Company," "we," "our," or "us"), including our website, software products, and AI-powered solutions, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.

These Terms apply to all visitors, users, clients, and any other persons who access or use our services.

2. Description of Services

Arisecraft Technologies provides enterprise software development, web application development, AI and machine learning solutions, cloud infrastructure services, and related IT consulting services. Our products include but are not limited to:

  • Custom enterprise resource planning (ERP) systems
  • AI-powered examination and proctoring platforms
  • Visitor and security management systems
  • Target and performance management tools
  • Educational technology solutions
  • Custom web and mobile application development

3. User Accounts

Certain services may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your account information is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Intellectual Property Rights

All content, features, and functionality of our services — including but not limited to software code, designs, text, graphics, logos, icons, images, audio clips, and data compilations — are the exclusive property of Arisecraft Technologies and are protected by Indian and international copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our services for their intended purpose. You may not:

  • Copy, modify, distribute, or reverse-engineer any part of our services
  • Use our services for competitive analysis or benchmarking
  • Remove or alter any proprietary notices or labels
  • Resell, sublicense, or commercially exploit our services without written consent

5. Acceptable Use Policy

You agree not to use our services to:

  • Violate any applicable local, state, national, or international law or regulation
  • Transmit any viruses, malware, or other malicious code
  • Interfere with or disrupt the integrity or performance of our services
  • Attempt to gain unauthorized access to our systems, networks, or data
  • Harvest, scrape, or collect personal information of other users without consent
  • Use our AI-powered tools for deceptive, discriminatory, or harmful purposes
  • Misrepresent your identity or affiliation with any person or organization

6. AI & Machine Learning Services

Certain services offered by Arisecraft Technologies incorporate artificial intelligence and machine learning technologies. By using these services, you acknowledge and agree that:

  • AI-generated outputs may contain inaccuracies and should be reviewed by qualified humans before reliance
  • We continuously improve our AI models, which may result in changes to service behavior
  • You will not use AI-generated content to mislead, deceive, or harm others
  • Data processed by our AI systems is handled in accordance with our Privacy Policy
  • We are not liable for decisions made solely based on AI-generated outputs

7. Payment Terms

For paid services, you agree to provide accurate billing information and authorize us to charge the agreed-upon fees. All fees are non-refundable unless otherwise stated in a separate service agreement. We reserve the right to modify pricing with at least 30 days' prior notice.

Late payments may incur interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

8. Service Level & Availability

We strive to maintain high availability and performance of our services. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance whenever possible.

Specific service level agreements (SLAs) may be established through separate enterprise contracts.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Arisecraft Technologies and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruptions or system failures
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content accessed through our services

Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to Arisecraft Technologies in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Arisecraft Technologies, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Udupi, Karnataka, India.

Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least thirty (30) days.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated "Last updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
